Don’t summon bizman in case involving ex-wife: HC to cops

Hyderabad: Justice B Vijaysen Reddy of the Telangana high court on Thursday directed Hyderabad police not to summon a complainant in a criminal case until further orders. The judge gave the interim order directing police not to interfere in the personal liberty of the petitioner, a businessman from Dabeerpura, and posted the case to Feb 6 for next hearing.
The Dabeerpura resident filed a writ petition alleging that ever since he lodged the complaint, the Borabanda police were summoning him repeatedly and harassing him to withdraw the case against the alleged accused, including his estranged wife and her second husband. He alleged that they (police) were acting at the behest of the second husband, a retired police officer.
The high court also issued notices to his wife and her second husband, against whom the allegations were made.
The businessman, in his petition, stated that he had married the woman in 2004 and they had three children. However, due to differences between the couple, his wife, along with their three children, left his home without informing him and also took away 40 tolas gold and 5 lakh cash with her. When she did not return despite repeated requests, he filed a complaint in the family court in 2017. Meanwhile, the woman married another person in Oct 2020 without obtaining ‘Khula’ or divorce from him.
In this connection, he lodged a complaint with the Borabanda police in Aug 2024, and a case was registered against his estranged wife, her second husband, and her family members and relatives. In the writ, the businessman alleged that police were harassing him, summoning him frequently to the police station, making him sit there for long hours, and threatening him to withdraw his case, his counsel contended.
