Vijayawada: The high court on Thursday declined to grant interim protection to former minister Kakani Govardhan Reddy in the case registered by Kavali police for allegedly issuing threats to TDP leaders and police. The court said interim protection cannot be granted in a quash petition when investigation is in its initial stages.
Kavali police registered a case against Kakani following a complaint lodged by one Padmaiah, who alleged that he made objectionable comments about Venkatachalam inspector Subba Rao and TDP leaders.
The former minister moved the high court seeking to quash the case. Arguing on his behalf, Dushyanth Reddy told the court that the case is politically motivated and sought interim protection as the petitioner is facing threat of arrest. He said there are instances where cases at the FIR stage are also quashed.
However, Justice K Srinivas Reddy said interim protection from arrest cannot be granted in a quash petition, especially when investigation is in the preliminary stages. If the petitioner is apprehensive about arrest, an anticipatory bail petition can be filed, he said, while issuing notices to police for filing of counters.
