Hyderabad: The Telangana high court questioned whether cops can force anybody to undergo a potency test or any medical tests unless they are allowed by the law or with consent. The HC made the observations while granting relief to a techie who alleged coercion from the cops to undergo a potency test.The man’s second wife accused him of allegedly cheating her by concealing his impotency during the marriage, following which Kukatpally police registered a case. Police registered a case against the petitioner in June 2025. His wife, 33, alleged that his first marriage also broke up after his first wife discovered his impotency. From the time she realised his impotency, his father was harassing her sexually, she alleged in her complaint to the police.“He and his father cheated me by inducing me into this marriage with him, harassing me physically, mentally, and emotionally,” alleged the woman. She also claimed that she quit her job and shut her boutique business at her husband’s demand.According to the 38-year-old petitioner, a cheating case was registered against him, but without investigating the case, the cops were forcing him to undergo a potency test against his will and were threatening him to settle the matrimonial dispute with his wife.In response, the govt pleader argued that without cooperating with the investigation, the petitioner invented the potency ground to approach the court to prevent the police from investigating the case against him.“The investigating officer was trying to serve notice to him under Section 35(3) of BNSS, and as he did not receive the notice, the notice was sent to him by registered post,” submitted the govt pleader.Taking a serious view of the allegations made by the petitioner, the HC ordered the cops not to indulge in acts outside the law and to conduct the investigation in strict compliance with the law and recently dismissed the petition.
