Hyderabad: The Supreme Court on Tuesday directed private parties claiming a large parcel of disputed 100 acres in Shamshabad and Paigah village of Shamshabad mandal in Ranga Reddy district, allegedly owned by HMDA, to refrain from any construction or from alienating or encumbering the property until the disposal of their appeal before the Telangana high court.The division bench of Justices MM Sundresh and Satish Chandra Sharma was hearing a petition filed by Mohammad Taher Khan, who claimed the land under certain survey numbers in the two villages. HMDA (then HUDA) had contended that it acquired around 180 acres in the 1990s and that when objections were raised over the enhanced award amount, the Supreme Court in 2009 ordered enhancement.In the appeal before the Telangana HC, Taher Khan had contended that Justice ND Patnaik of the HC of united Andhra Pradesh issued orders in favour of private persons in April 1988. The division bench of the Telangana HC noted that Justice ND Patnaik was elevated to the bench of the then United AP HC only in Dec 1988 and therefore could not have passed an order in April 1988.However, in April 2025, a division bench of the Telangana HC found that one of the judicial orders submitted by Taher Khan was fabricated and directed the Charminar police to file a criminal case against him and directed the govt to constitute a special investigation team to probe the matter. The court also issued status quo orders until finalisation of the appeal.After registration of the FIR and while the appeal was pending, Taher Khan approached the Supreme Court seeking to vacate the stay orders issued by the HC. Denying any relief, the Supreme Court reiterated that no construction or alienation of any land parcels should take place until the matter is disposed of by the Telangana HC.
