Bombay High Court: High Court takes a dig at the government regarding the cases pending in the courts, know the matter – Bombay High Court Takes Dig At Center Ease Of Doing Business Over Mindful Of Pendency Of Cases

The Bombay High Court recently took a dig at the ‘Ease of Doing Business’ policy of the Central Government and asked whether it was even aware of the cases pending in the courts. The High Court said that the government is the biggest litigant and it demands postponement of the hearing the most. A division bench of Justice Gautam Patel and Justice Kamal Khata said this on October 5 during the hearing of a petition related to the property of Ramkali Gupta. The petition which was heard by the High Court was filed in 2016.

During the hearing, the High Court tauntedly said that we know that the Central Government often comments on the cases pending in the courts, but the court is surprised to know that the petition of Ramkali Gupta is pending for the last seven years and since June this year, the petition has been pending. It is pending due to the fact that the Additional Solicitor General is not able to appear in the Court. The court said that we know that the Central Government keeps commenting on the cases pending in the courts and continuously adjourning the hearing. What the government calls it is ‘Ease of Doing Business’.

The bench said that as per its convenience, the government comments on the cases pending in the courts but the fact is that the government is the biggest litigant and mostly it gets the cases postponed. The court also said that the Additional Solicitor General cannot come to hear every case but any lawyer attached to his office can discharge the duties of his office. The court expressed strong displeasure over the repeated adjournment of the petitions.
