Justice K. Lakshman of Telangana High Court on Monday issued notices to the State government and others in a criminal petition filed by Assembly Speaker Gaddam Prasad Kumar seeking to quash proceedings in a case of model code of conduct on violation registered during 2019 Lok Sabha election campaign period.
The petitioner contended that he was in no way connected to the case. The case was registered under Section 188 of the Indian Penal Code based on a complaint filed by M. Rambabu, Vikrabad Election Flying Squad in-charge, that Prasad Kumar (who was ex-MLA then) participated in a hunger strike before Vikararabad Revenue Division Office.
Since there was no permission given to organise the hunger strike, it amounted to violation of model code of conduct, the complainant said. Among the participants in the hunger strike were Chevella MP Konda Vishweshwar Reddy and others.
Police filed a chargesheet in the local court. It was eventually transferred to a special court in Hyderabad for conducting trial. The petitioner stated that he did not participate in the said protest programme. The allegations levelled did not constitute an offence, he said.
