T HC stalls HYDRAA bid to raze sheds in Meerpet

Hyderabad: Justice K Lakshman of the Telangana HC on Monday stayed proposed demolition of two structures at Almasguda in Rangareddy and directed HYDRAA chief along with municipal administration secretary to act in the matter only after receiving replies and documents from the owner of the structures after giving him an opportunity of being heard and four weeks of time to do so.
The judge issued interim order after hearing a lunch motion moved by 75-year-old Jakkidi Anji Reddy of Almasguda, who questioned the HYDRAA CI’s Jan 10 notice that charged the petitioner with encroaching upon Meerpet Talab (Pedda Cheruvu) and raising two sheds in 260 and 276 square yards of plots in the tank bed. He claimed that he obtained permission from the gram panchayat in Aug 2012.
The HYDRAA notice wants the petitioner to furnish within three days the details of sanctioned plan, link documents and registration documents, etc. As the subsequent three days were holidays even for HYDRAA, the same could not be furnished. In fact on Jan 12, the petitioner said, even HYDRAA office was found closed because it was a Sunday and the previous day was a second Saturday. Since HYDRAA CI said that they received a complaint against the petitioner, a copy of it should be given to the petitioner, Justice Lakshman said.
The judge also sought to know from HYDRAA and the municipal administration whether the authorities had issued a final notification determining the FTL. “If the petitioner fails to furnish documents, the authorities are free to act against him in line with law,” the judge said, while closing the writ petition.
