UCC implemented in Uttarakhand

Today, since 27 January 2025, the Uniform Civil Code has been implemented in Uttarakhand. Uttarakhand has become the first state to do so with this historic step. Chief Minister Pushkar Singh Dhami made a formal announcement at the Chief Minister’s residence today. What is the Uniform Civil Code?

In every country, laws are mainly divided into two parts – criminal and civil. Criminal law applies to cases such as theft, murder, or violence. It has equal rules and punishment for all religions and communities. Civil law applies in private matters like marriage, divorce, property disputes. It is based on customs and traditions.

There are different personal laws for different religions in India. For example, the rules of marriage and divorce for Hindus come under the Hindu Marriage Act, while for Muslims they are based on Muslim personal law. Similarly, there are different laws for Christians and Sikhs. Through the Uniform Civil Code, an attempt has been made to bring equality in matters related to marriage, divorce and property for all religions.

Legal age of marriage: Now the minimum marriage for all religions will be 21 years for boys and 18 years for girls. There was a separate system in the Muslim law till now. Also, marriage registration will be mandatory.

Rules similar to divorce: The process and base of divorce in different religions were different. For example, there is a 6 -month separation in Hinduism, while in the Christian community this period is 2 years. Under the UCC, the rules and procedures of divorce will now be the same.

Integration of polygamy and halala The practice of polygamy and halala in the Muslim community will now end. The second marriage will be allowed only when the first wife is divorced or she is not there.

Property and Succession: Now in all religions, daughters will get equal rights in the property of parents. Currently this provision was only for Hindu girls.

Adoption right: Earlier Muslim women could not adopt children. After the implementation of the UCC, women of all religions will get equal rights to adopt.

New rules for live-in relationship also

Special provisions have also been made on live-in relationship. They will apply to all people, whether they are residents of Uttarakhand or not. Those living in live-in relationship will have to register. For registration, both are required to be adult and there should be no blood relation or family relationship between them.

If there is a child while living in live in, then it will be considered valid. At the end of the live-in relationship, women will be able to claim maintenance and alimony. If someone does not register live-in within a month, then he can get a fine of 3 months and a fine of Rs 10,000. On giving incorrect information, the fine can increase to up to 25 thousand rupees.

Special provisions for soldiers also

In the UCC, separate rules have been made for army personnel regarding will. They can also do a will by writing by hand or by giving oral instructions. It has to be verified in front of two witnesses. However, it should be proved that the will of the will was written by the soldier. Some Scheduled Tribes of Uttarakhand, who are protected under Part 21 of the Constitution, have been exempted from UCC. These tribes are about 3% of the total population of the state.
