Hyderabad:The Telangana High Court upheld the decision of the state government and Kaloji Narayana Rao University for Health Sciences (KNRUHS) in restraining candidates who had obtained Scheduled Castes certificate in Andhra Pradesh, to avail the benefits of reservations in PG medical admissions in Telangana, in the 50 per cent seats to be filled up by the state and the health university.
The High Court on Monday dismissed a batch of petitions filed by AP students challenging the memo issued by the university, which mandates the candidates claiming SC and other categories to upload the latest social status certificate issued by the competent Telangana government authorities. They requested the court to issue directions to the university to recognise the certificates issued to them in AP.
A division bench, comprising acting Chief Justice Sujoy Paul and Justice Renuka Yara, dismissed the petitions challenging the decision of the university.
The contention of the petitioners was that since the reservation benefits pertaining to the SC community were not adversely affected in Telangana even after the bifurcation, the same should continue. The state, which extended such a facility till 2023, had stopped it last June after the admission process was notified.
Advocate-general A. Sudarshan Reddy, appearing for Telangana, argued that there was a ten-year protection in the bifurcation Act, which ended on June 2, 2014. The purpose of state bifurcation would be defeated if the AP caste certificates are considered in Telangana.
He also brought to the notice of the court the judgments of constitutional benches of the apex court that gave primacy to the decisions of the state that is sheltering migrants.
