Hyderabad: Telangana high court on Thursday admitted two writ appeals filed by the former management of Ibadat Khana-e-Hussaini, Darulshifa, against an order by a single judge requiring its reconstitution.
A division bench comprising Acting Chief Justice Sujoy Paul and Justice Renuka Yara stayed a portion of the single judge’s order directing the reconstitution of the management committee of Ibadat Khana-e-Hussaini, Darulshifa, by nominating equal numbers from the Usooli and Akhbari sects. The bench observed that the matter needed to be judicially reviewed and accordingly posted the matter for a final hearing to July.
P Venugopal, appearing for the petitioner Anjuman-e-Alavi, a registered society aggrieved by the alleged inaction of the waqf board in giving them equal representation in the managing committee of the waqf institution, pointed out that there was no error in the single judge’s order.
Appellants’ counsel L Ravichander pointed out that the order of the single judge, issuing a direction for reconstitution in the specified manner, was not even sought. They also contended that the single judge construed the documents in a piecemeal and selective manner, contrary to the established facts and circumstances of the case, which resulted in a misappreciation of evidence, leading to a miscarriage of justice.
