Hyderabad: Justice B Vijaysen Reddy of the Telangana High Court on Wednesday directed a petitioner, EB Dakshina Murthy to move his dog, a Dogo Argentino breed named Ares away from his residence at Chikkadpally and shift it to a safe place away from strangers.
Dakshina Murthy had filed a writ plea challenging the action of GHMC officials in taking his dog into custody on May 19 based on police instructions. The Chikkadpally police had registered a crime based on the complaint of the petitioner’s brother EB Narasimha Murthy.
The allegations in the criminal case involved the petitioner and his family allegedly using the dog, which is banned in India, to threaten Narasimha Murthy and other residents in Ekkaladevi Elite Residency in Chikkadpally.
Narsimha Murthy filed a criminal complaint alleging that the dog attacked him on May 18, placing the medical records on the injuries survived by him.
Dakshina Murthy, however, contended that the dog was taken away without notice. He complained about the inadequate facilities with GHMC to take care of Ares and complained that Ares was kept in a small cage.
Considering the food and medical treatment that Ares would require, Justice Reddy directed the release of the dog and directed the petitioner to move it away from his residence to a place where no harm could be caused to strangers.
Further, directing to implead Narsimha Murthy in the case, the judge made it clear that GHMC could take action in accordance with law if the dog breed was banned in India.
