Plea Challenges Reservation for Sarpanch Posts

Hyderabad: A petition was filed before the Telangana High Court challenging the 100 per cent reservation for gram panchayat sarpanch and ward members’ posts in the Scheduled Areas of Telangana in favour of Scheduled Tribes (STs) and no rotation for other classes.

The writ petition was filed by the Non-Tribal Welfare Society, represented by its secretary Kondabathina Madhu. The petitioner sought a declaration that the 100 per cent reservation for STs in these posts was unconstitutional, contending that it violated Articles 14 and 15 of the Constitution of India.

The plea cites the Supreme Court’s judgment in ‘Chebrolu Leela Prasad Rao & Ors vs State of Andhra Pradesh & Ors’, which laid down limits on reservations in local body elections.

The petition came for hearing before the single bench judge of Justice T. Madhavi Devi who said that the issue raised questions on constitutional provisions. The judge directed the Registry of the High Court to place it before the Division Bench.
