For many Indians holding H1B visas, the final months in the U.S. are often filled with stress, documentation challenges, and fear of what comes next. One such case involves an Indian professional whose initial H1B term is set to expire on September 30, 2025. After their work contract ended in February, they’ve been urgently searching for a new sponsor while navigating shifting immigration rules.
In an effort to remain legally in the U.S., the individual has applied for a change of status to a B2 visa. If approved, it would extend their stay only until November 15, 2025, providing a temporary solution while they figure out the next step. The uncertainty after that date continues to hang over them.

Immigration attorneys note that while a second B2 extension request is possible, it carries no assurance. USCIS thoroughly evaluates each applicant’s immigration history, reasons for the stay, and compliance. Even if granted, a B2 extension merely delays the inevitable, offering short-term relief rather than permanent resolution.
At the same time, the H1B lottery remains highly unpredictable. Delays in processing times and approvals add more pressure. Some applicants succeed with multiple B2 extensions, but many face denials if USCIS suspects misuse or lack of valid purpose for the stay.

Legal experts urge those in similar situations to prepare early. Keeping records of job search efforts, maintaining legal compliance, and consulting with an experienced immigration attorney are essential. Proactive action often makes the difference between staying legally or falling out of status.
But beyond the legal aspect lies a deeper emotional struggle. For someone who has lived in the U.S. for over 12 years, returning to India feels like erasing years of growth. “I left at 17. Now I’m 29. Returning would be like stepping into a past that no longer fits,” the individual shared.
