Telangana HC directs Hyderabad school to reinstate Class VIII student injured in class mishap ‘without conditions’ | Legal News


The Telangana High Court on Friday directed a school in Hyderabad to immediately allow a Class VIII student to attend regular classes and all related activities, criticising the school management for reportedly expelling the student mid-academic year over an FIR registered against the school on a complaint by her parents.

Justice Surepally Nanda directed the management of Nasr School at Khairatabad to let the student continue her classes from October 25, “without insisting on any further conditions, formalities, or undertakings,” and most importantly, “without subjecting the petitioner to any form of discrimination, harassment, or exclusion”.

The ruling came on an interlocutory application filed by the 13-year-old to secure the continuity of her education during the pendency of her main writ petition.

The case stems from an incident that occurred in the school on June 30 when a ceiling fan fell on the student while she was in the classroom. The student’s eyesight was impacted following the accident, and her parents lodged a complaint with the police, alleging negligence on the school’s part.



The petitioner’s counsel claimed that she was expelled from the school after the FIR on August 25 via an official communication from the principal.

The counsel for the respondent, Nasr school, claimed that the student had not been attending classes since the last week of August 2025, disputing the petitioner’s claim that she was being barred from entry. The counsel added that the student’s relatives had posted defamatory content against the school on social media.

The court decisively ruled in favour of the student’s right to attend school without delay. The order explicitly directed the school to ensure that the student is treated as a “bona fide student on the rolls of the school” and must be permitted to participate in all regular classes and co-curricular activities starting from October 25.

The ruling orders the reinstatement of the student to ensure her education is not further disrupted. The interlocutory application was ordered accordingly, and the main writ petition has been scheduled to be listed on November 3, for the respondents to file their counters.
