Telangana HC refuses to release man detained with Bangladeshi ID and Indian passport | Legal News


The Telangana High Court Friday refused to grant any relief to a businessman held in detention by the Foreigners Regional Registration Office (FRRO).

A movement restriction order was issued against the detainee in September, and since then, he has been lodged at the detention centre in the Central Crime Station, Hyderabad.

The detainee’s father, Nirmal Das, had filed a habeas corpus petition in the matter.

The detainee, Sanjit Das, is a native of Tripura and currently resides in the city. He was detained at the Rajiv Gandhi International Airport when he was attempting to fly out to Abu Dhabi.

While his Indian passport was found to have been obtained allegedly using forged documents, Sanjit Das was also allegedly found in possession of an identity card issued by the Government of Bangladesh.

The division bench, while delivering the directions, noted, “Despite being a citizen of Bangladesh, he has fraudulently obtained an Indian passport. We do not find any reasons to release the detenue.”

Nirmal Das approached the high court claiming that the detention was illegal and sought his immediate release. The counsel for the State, during the hearing, said the detainee was not detained illegally but under the Immigration and Foreigners Act.

The bench noted that they did not find any scope for interference in the order of habeas corpus for the release of the detainee since the FRRO has acted in compliance with the Immigration and Foreigners Act.

“He, however, is at liberty to avail recourse under the provisions of the act and represent his case before the FRRO for further proceedings,” said the bench and disposed of the matter.
