Parliament Winter Session 2023 Live Updates (December 4): The Lok Sabha Ethics Committee is expected to table its report recommending the expulsion of Trinamool Congress (TMC) MP Mahua Moitra today, following the cash-for-query allegations levelled against her. The House was adjourned within minutes of it convening in the morning, after Opposition MPs disrupted the proceedings. BSP MP Danish Ali, who came to the House hanging two placards on his neck saying “Humiliation to an MP is an insult to Parliament” and “Punish Bidhuri, Save Democracy” ran to the well of the house shouting that he was insulted by BJP MP Ramesh Bidhuri but no action was taken against him. Both Lok Sabha and Rajya Sabha have been adjourned till 2 pm.
Addressing reporters before the Session, Prime Minister Narendra Modi said this was a “golden opportunity for Opposition parties to do something constructive”. He added that their nine years of spreading negativity had not paid results, as was clear by yesterday’s results, and this was a chance for them to “change”.

The government has listed several Bills for passage in this session, which is set to be a short one– it will conclude on December 22 after 15 sittings. These Bills include the Bharatiya Nyaya Sanhita, Bharatiya Citizen Security Code and Bharatiya Sakshyawhich will replace the Indian Penal Code (IPC), the Code of Criminal Procedure (CrPC), and the Indian Evidence Act respectively. The Opposition is expected to unite and attack the government over these Bills. The government has also listed The Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023, which had ruffled some feathers over its provisions that seem to downgrade the status of an Election Commissioner from that of a Supreme Court judge to that of a Cabinet Secretary.

The rules governing the procedures of the Lok Sabha Ethics Committee — incorporated in Chapter XXA of the Rules of Procedure and Conduct of Business in the Lok Sabha in August 2015 — state that the recommendations of the Committee shall be in the form of a report and it shall be presented to the Speaker who may direct that it be tabled in the House. The rules say that the report “may also state the procedure to be followed by the House in giving effect to the recommendations made by the Committee”. Rule 316 E lays down the procedure to be adopted for consideration of the report by the House. “After the report has been presented, the Chairperson or any member of the Committee or any other member may move that the report be taken into consideration whereupon the Speaker may put the question to the House,” it reads. Before putting the question to the House, the rules say the Speaker may permit a debate on the motion not exceeding half an hour. After the motion is agreed to, the chairperson or any member of the committee, or any other member, “may move that the House agrees or disagrees, or agrees with amendments, with the recommendations contained in the report”. Rule 316 F says that “a motion that the report of the Committee be taken into consideration shall be put down in the list of business after disposal of questions”.
